Linda J. Brewer is a partner in the San Francisco Office of Quinn Emanuel Urquhart & Sullivan, LLP.  Linda  specializes in complex commercial litigation, representing both plaintiffs and defendants in a wide variety of high-stakes business litigation.  Her diverse litigation experience includes unfair competition, intellectual property, securities, insurance, employment, trade secret misappropriation, antitrust, and mass tort matters.  While the subject matter of her practice can vary depending on a client’s needs, there is always a common thread: strategic lawyering and successful results.  

Linda has an active trial practice and has conducted jury trials in the Northern District of California and Western District of Arkansas, bench trials in California and Delaware state courts, and has argued before numerous state and federal courts and administrative agencies.  Outside of the courtroom, she is frequently invited to speak at national conferences on e-discovery and intellectual property matters.  She also has significant experience in dispute resolution, having overseen a mediation program for a California utility that successfully resolved thousands of wildfire claims in less than three years, including the resolution of thirteen preference and three bellwether cases set for trial in Sacramento Superior Court.  She has deep familiarity with the Northern District of California, having served as law clerk for the Honorable Saundra Brown Armstrong, in the Oakland Division, and an extern for the Honorable Ronald Whyte in the San Jose Division. 

Linda received a Bachelor of Arts degree in philosophy from Dartmouth University and a J.D. from Duke University School of Law.  While at Dartmouth, Linda participated in the Foreign Studies Programs for both Philosophy and Environment Studies and lived in Edinburgh, Scotland and Nairobi, Kenya.

  • Successfully represented D&O insurer, Allied World Assurance Co., in a bench trial in San Mateo Superior Court addressing a question of first impression and of critical importance to the D&O industry: the definition of Loss and whether it covers indemnified settlements paid to resolve a shareholder dispute over the price per share paid for Amgen’s purchase of Onyx Pharmaceuticals.    A final decision from the trial court is expected in 2020 Onyx Pharmaceuticals, Inc. v. Allied World Assurance Co, et al.; Case No. CIV538248 (Superior Court of the State of California, County of San Mateo).
  • Represented PG&E in defense of a mass tort action involving claims of subrogated insurers, government entities, and homeowners asserting over $2 billion in claimed property and other damages.  Oversaw a mediation program that successfully resolved over 2,800 homeowners’ lawsuits seeking uninsured losses.
  • Represented Qualcomm Inc. in patent infringement suit brought by MicroUnity Systems Engineering, Inc. in the Eastern District of Texas involving microprocessor technology.  Case resolved through a settlement on terms favorable to Qualcomm. 
    Defeated class certification in two multi-billion dollar antitrust class actions before the Northern District of California that asserted price fixing in sales of flash memory.  The Court of Appeals declined to reconsider the District Court's decision to deny class certification.  Case resolved through a voluntary dismissal of the direct purchaser action and a settlement of the indirect purchasers’ claims on terms favorable to Samsung.
  • Represented Palm in a series of patent infringement cases brought by Aloft and Stragent in the Eastern District of Texas relating to smartphones and personal digital assistants.  The cases settled on terms favorable to Palm prior to claim construction.
  • Represented Samsung in a case brought by Positive Technologies, Inc. in the Eastern District of Texas, involving LCD driving techniques.  Case resulted in positive settlement for Samsung prior to claim construction.
  • Represented AccessClosure, Inc. in a patent infringement jury trial in the Western District of Arkansas.  Jury trial resulted in the finding of invalidity for one of the patents in suit.
  • Represented InterActiveCorp and LendingTree.com in patent infringement action related to internet business methods, resulting in a successful outcome of invalidity and non-infringement following an appeal to the United States Court of Appeals for the Federal Circuit. 
  • Represented Synopsys, Inc. in a merger termination bench trial in the Delaware Chancery Court.  Case settled on terms favorable to Synopsys during trial.
  • Represented Palm Inc., as a plaintiff, in a suit involving auction rate securities filed against Merrill Lynch, arising out of Merrill’s sale of auction rate securities backed by CDOs and other derivative products.  Successfully defeated Merrill Lynch’s motion for summary judgment, followed by a settlement favorable to Palm immediately prior to trial.
  • Defeated a motion for temporary restraining order filed by investors in a Madoff-feeder fund against the fund’s managers, which resulted in the investors staying all litigation against the fund’s managers, and ultimately a favorable settlement of the class and derivative claims.
