Damian Scattini



Damian Scattini is a partner in Quinn Emanuel’s Sydney office. Before joining the firm, Damian was a Principal at the largest Australian plaintiff’s class action firm and head of its Queensland class actions practice. He has more than 25 years’ of commercial litigation experience.

Damian is one of the leading corporate plaintiff and class action lawyers in Australia. Before joining the firm, Damian was a Principal at the largest Australian plaintiff’s class action firm and head of its Queensland class actions practice. He has more than 20 years’ of commercial litigation experience. Damian led the class action against the Bank of Queensland (and many other confidential actions). He is running six class actions in the Supreme Court of NSW against vehicle manufacturers arising out of the Takata airbags recalls.

He has also led a number of prominent class actions, including a class action against the operators of Wivenhoe and Somerset Dam in relation to the January 2011 flooding of thousands of homes and businesses in South-East Queensland. He has acted in numerous product liability cases in the United States as Australian counsel, including representing the families and survivors after two military helicopters collided and crashed, killing 18 Australian special forces troops and injuring several others.  Clients regularly comment on his strategic acumen, judgement and ability to generate successful outcomes.  Damian was recently ranked as a Recommended individual for Dispute Resolution in Legal 500 Asia Pacific 2017.

  • Developed and implemented a redress scheme with Australia’s leading banks on behalf of thousands of individuals who had been leveraged into inappropriate loans by a collapsed financial planning company. The Storm Financial Resolution Schemes became the template for other redress schemes following the 2008 financial crisis. The various redress schemes resulted in compensation to investors worth over $300 million.
  • Led Australia's largest class action to date in relation to Queensland's devastating 2011 floods. A claim that centred on the operation of the Wivenhoe and Somerset Dams which were operated negligently and contributed to the scale of the disaster by releasing large amounts of water to prevent the dam collapsing.
  • Acted against mining giant Xstrata, the Queensland Government and the local council regarding the emissions from the Xstrata's Mt Isa mine in the claimed lead poisoning of local children.
  • Ongoing class action on behalf of hundreds of businesses against the Commonwealth of Australia for the negligent operation of a quarantine facility which caused the 2007/2008 Equine Flu which was Australia's largest animal disease emergency.
  • Conducted to judgment or settlement over 500 negligence and misleading and deceptive conduct claims against hotel operators, property developers and associated professional firms arising out of property marketing scams in Australia.
